1. Introduction
This Privacy Policy explains how Innolope LLC ("Innolope", "Bergman", "we", "us", or "our") collects, uses, shares, and protects information in connection with the Bergman platform, including the Bergman macOS application, the Bergman Twin meeting service, the Bergman Memo recording and sharing service, our website at bergman.digital, browser extensions, and related services (collectively, the "Service").
By using the Service, you acknowledge that you have read and understood this Privacy Policy. This Privacy Policy is incorporated into and forms part of our Terms of Service. If you do not agree with our practices, please do not use the Service.
This Privacy Policy is global in scope. Depending on where you live, you may have additional rights described in Section 8.
2. Information We Collect
2.1 Account and Profile Information
When you create an account, we collect information such as your name and email address. If you sign in through a third-party authentication provider such as Google (via Firebase Authentication), we receive basic profile information from that provider. We also assign you an internal user identifier.
2.2 Content You Create and Capture
The core of the Service involves capturing, storing, and processing content that you create. This includes:
- Meeting recordings: audio, video, shared screens, and presented content captured by Bergman Twin when it attends a meeting at your direction
- Memos: screen recordings and audio narration you create with Bergman Memo, together with titles, descriptions, and visibility settings (such as public, unlisted, or private)
- Transcripts: text transcriptions generated from your recordings and memos
- AI-generated content: summaries, key points, action items, and other insights generated from your content
- Uploaded materials: avatars, background images, logos, and other files you upload to the Bergman macOS application or the Service
Recordings and memos may contain the voices, images, names, and statements of meeting participants and other individuals. See Section 6 for important information about this content.
2.3 Calendar and Meeting Information
If you connect a calendar (such as Google Calendar), we access the calendar and event information needed to identify and join your meetings, including event times, titles, participants, and meeting links. We also process meeting links you provide manually, along with meeting metadata such as platform, start and end times, and duration.
2.4 Subscription and Billing Information
If you subscribe to a paid plan, our payment processor (Creem) collects and processes your payment information. We do not store complete payment card details. We store billing-related records such as your plan, subscription status, renewal dates, and the customer and subscription identifiers provided by our payment processor, along with usage information relevant to your plan limits.
2.5 Usage, Device, and Diagnostic Information
We automatically collect certain technical and usage information when you use the Service, including device and operating system information, app version, log data, IP address, browser type, and information about how you interact with the Service. We use error monitoring (such as Sentry) and product analytics (such as TelemetryDeck on the macOS application) to diagnose problems and improve the Service.
2.6 Cookies and Local Storage
Our website and applications use cookies and similar technologies (including local storage) to keep you signed in, remember preferences, and operate the Service. You can control cookies through your browser settings, though some features may not function without them.
3. How We Use Information
We use the information we collect to:
- Provide, operate, and maintain the Service, including joining and recording meetings with Bergman Twin and hosting, delivering, and sharing your recordings and memos
- Transcribe your recordings and memos and generate summaries, key points, action items, and other insights
- Authenticate you and secure your account
- Process subscriptions, billing, and payments
- Provide customer support and respond to your requests
- Monitor, troubleshoot, secure, and improve the Service, including through error monitoring and product analytics
- Send you service-related communications, and, where permitted, product updates
- Detect, prevent, and address fraud, abuse, security incidents, and violations of our Terms
- Comply with legal obligations and enforce our agreements
4. AI Processing of Your Content
To provide transcription, summaries, and other AI-powered features, we process your recordings and memos using AI and speech-to-text technologies, which may be operated by us or by trusted third-party providers acting as our service providers (subprocessors). Where third-party providers are used, they process your content solely to provide functionality to us and under obligations of confidentiality.
We do not sell your content, we do not share your content with third parties for their own independent purposes, and we do not permit our AI providers to use your content to train their or any third party's models. AI-generated transcripts and summaries may contain errors and should not be relied upon as a verbatim or authoritative record.
5. How We Share Information
We do not sell your personal information. We share information only in the following circumstances:
5.1 Service Providers and Subprocessors
We share information with third-party service providers that perform services on our behalf and process data under our instructions and confidentiality obligations, including:
- Firebase Authentication and Google (sign-in and authentication)
- MongoDB Atlas (database and storage of account and metadata)
- Cloudflare Stream (hosting, encoding, and playback of video recordings and memos)
- Creem (payment processing)
- AI and speech-to-text providers (transcription and summaries)
- Sentry and TelemetryDeck (error monitoring and product analytics)
5.2 Recipients You Designate
When you share a Bergman Memo or a recording link, the content is accessible to the recipients and according to the visibility setting you choose (for example, anyone with the link, or only specific people). You are responsible for the recipients you select and the visibility you set.
5.3 Meeting Participants
When Bergman Twin attends a meeting on your behalf, your presence as a participant (and any recording) may be visible or disclosed to other participants depending on the meeting and platform settings and applicable law. You are responsible for the consents and disclosures required for that attendance and recording, as described in our Terms of Service.
5.4 Legal and Safety
We may disclose information if required by law, subpoena, or legal process, or if we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.
5.5 Business Transfers
If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction, subject to this Privacy Policy.
6. Recordings and the Privacy of Others
Recordings, memos, and transcripts you create may contain personal information of meeting participants and other individuals, including their voices, images, names, and statements. With respect to that content, you act as the controller and we act as a processor handling it on your behalf and at your direction.
You are solely responsible for having a lawful basis to record and process that content, for obtaining all necessary consents, and for providing all required notices to participants, as set out in our Terms of Service. We do not independently obtain consent from meeting participants and rely on you to do so.
7. Data Retention
We retain your content and information for as long as your account is active or as needed to provide the Service. You can delete individual recordings or memos, and you can delete your account at any time, after which we will delete your associated content within a reasonable period, except for copies retained in routine backups or as required by law. We may retain certain information (such as billing records) for longer where necessary to comply with legal, tax, or accounting obligations, resolve disputes, or enforce our agreements.
8. Your Rights and Choices
Depending on your location, you may have some or all of the following rights regarding your personal information:
- Access a copy of the personal information we hold about you
- Correct inaccurate or incomplete information
- Delete your personal information
- Export / portability of your information
- Object to or restrict certain processing
- Withdraw consent where processing is based on consent
You can exercise many of these rights directly through your account settings, including deleting recordings and memos, disconnecting your calendar, and deleting your account. Calendar access: You can revoke our access to your connected calendar at any time through your account settings or your calendar provider's settings.
Analytics and communications: You can opt out of non-essential communications through the unsubscribe link in our emails or your account settings.
If you are in the European Economic Area, the United Kingdom, or a jurisdiction with similar laws, you also have the right to lodge a complaint with your local data protection authority. If you are a California resident, you have rights under the CCPA/CPRA, including the right to know, delete, and correct, and the right not to be discriminated against for exercising your rights; we do not sell or share your personal information as those terms are defined under California law.
9. Security
We implement reasonable technical and organizational measures designed to protect your information, including encryption of recordings, transcripts, and summaries in transit and at rest, access controls, and authentication safeguards. However, no system is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the security of your account credentials and should notify us immediately of any suspected unauthorized access.
10. International Data Transfers
We are based in the United States, and our service providers may store and process information in the United States and other countries. If you access the Service from outside these countries, your information may be transferred to, stored, and processed in a country whose data protection laws differ from those in your jurisdiction. Where required, we rely on appropriate safeguards (such as standard contractual clauses) for international transfers.
11. Children's Privacy
The Service is not directed to children under sixteen (16) years of age, and we do not knowingly collect personal information from children under that age. If you believe a child has provided us with personal information, please contact us at [email protected] so we can delete it.
12. Third-Party Services and Links
The Service integrates with and links to third-party services, including authentication, calendar, meeting, payment, hosting, and analytics providers. Their handling of your information is governed by their own privacy policies, and we are not responsible for their practices. We encourage you to review the privacy policies of any third-party services you use in connection with Bergman.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we make material changes, we will notify you by posting a notice on the Service, sending an email, or other reasonable means, and we will update the "Last Updated" date above. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Privacy Policy.
